Regulated Products Policy

This policy governs the sale and distribution of products regulated by U.S. Federal and State agencies, including but not limited to, the Environmental Protection Agency (EPA). Dana Home is committed to full compliance with all applicable laws and regulations to ensure the safety and legality of every transaction.

1. Scope of Policy: Refrigerants

This section specifically applies to the sale of regulated refrigerants, including: R134a, R404A, R22, and other ozone-depleting substances (ODS) and non-exempt substitutes.

1.1. Sales Restriction (EPA Section 608/609)

Pursuant to the U.S. Clean Air Act (Section 608 and 609, 40 CFR Part 82, Subpart F), the purchase of most refrigerants is restricted to certified professionals only.

Permitted Purchasers:

  • EPA Section 608 Certified Technicians: Individuals certified under the Section 608 program (Type I, II, III, or Universal).

  • Employers of Certified Technicians: Companies or entities that employ at least one properly certified Section 608 technician (or an authorized representative acting on their behalf).

  • EPA Section 609 Certified Technicians: Individuals certified under the Section 609 program may only purchase refrigerants acceptable for use in Motor Vehicle Air Conditioners (MVACs).

Prohibited Purchases:

  • Refrigerant cannot be sold to an individual who is not certified and is purchasing for personal use in stationary appliances (non-MVAC).

  • Section 609 Certified Technicians are prohibited from purchasing refrigerants intended for use in stationary refrigeration/AC equipment (e.g., R-22, R-404A).

1.2. Certification and Verification Process

By completing a purchase of any regulated refrigerant product, the buyer certifies that they meet one of the criteria for a Permitted Purchaser listed above.

All buyers must complete the following steps at checkout:

  1. Acknowledge and agree to the terms of this Regulated Products Policy.

  2. Provide their EPA Certification Type and License Number (or a list of authorized purchasers if buying on behalf of a company).

  3. Upload a copy of the EPA Section 608/609 certification card or a company-issued letter verifying the employment of certified technicians.

Dana Home reserves the right to cancel any order for regulated products if:

  • The required certification information is incomplete, invalid, or cannot be verified.

  • The transaction is deemed non-compliant with federal or state law.

1.3. Record Keeping

As required by the EPA, Dana Home is obligated to maintain records for three (3) years from the date of sale for all regulated refrigerant transactions. These records will include:

  • The name of the purchaser.

  • The date of sale.

  • The quantity and type of refrigerant purchased.

  • Documentation verifying the purchaser’s (or their employer’s) certification status.

2. General Regulated Products Guidelines

This policy applies to all products that may be classified as hazardous, restricted, or regulated by any federal, state, or local body, including but not limited to:

  • Hazardous Materials: Products classified as hazardous for transport (e.g., certain chemicals, batteries, flammable liquids).

  • Age-Restricted Products: Products requiring the purchaser to meet a minimum age (e.g., certain power tools or industrial equipment).

  • State-Specific Products: Items restricted for sale in certain states or localities.

It is the responsibility of the Buyer to ensure they are compliant with all local laws regarding the purchase, possession, and use of any regulated product offered by Dana Home.
